General (articles 1 to 6)
Article 1. In these regulations: the board means the board of the Recreatiehaven Schagen foundation; the harbour coordinator is the person who directs the harbour masters and other volunteers and represents the harbour; the harbour master is the person in charge of the day-to-day supervision of the harbour; the recreational harbour means the entire harbour grounds, consisting of the recreational part of the harbour, the associated building, the car and motorhome parks and the navigable water; the berth holder is the private tenant who uses a berth against payment of an annual rate or part of it; the visitor (passant) is anyone who takes a berth or pitch from the foundation at the nightly rate; and a guest is anyone visiting the harbour or visiting a berth holder or visitor. Article 2. These regulations apply to the entire harbour grounds of Recreatiehaven Schagen, including the navigable water, the harbour building and the car and motorhome parks. Article 3. The harbour is open to berth holders and visitors, their family members and their guests. Visitors must report to the harbour master immediately upon arrival and moor, or park their motorhome, at the place allocated to them. Article 4. Everyone in the harbour must follow the instructions of the harbour coordinator, the harbour master and board members. Article 5. The foundation, the harbour staff and the municipality of Schagen are not liable for damage of any kind or from any cause to persons or property, or for loss or theft. You are liable for damage caused by yourself, your family members or your guests. Boats and motorhomes are not insured by the foundation or the municipality; please arrange adequate insurance yourself. All motorhomes and boats, with the exception of rowing boats and dinghies, must carry at least third-party liability insurance. Article 6. These regulations are supplemented where necessary by notices on the notice board; users of the harbour are expected to take note of them and act accordingly.
Berths and pitches (articles 7 to 11)
Article 7. A permanent berth is allocated on request, subject to availability, for successive periods of one year. The contract period runs from 1 April to 31 March and is tacitly renewed each year; the annual mooring fee must be paid within 14 days of the invoice date. If a berth is allocated during the year, no fee is charged for full months already passed. If you cancel between 1 January and 1 April, the annual fee already paid is refunded; if you cancel between 1 April and 31 May, the refund is pro rata for the remaining full months; after 31 May no refund is given. If the boat is sold, the new owner may, with the berth holder's consent, use the berth until 31 March; to keep a berth after that date a new application is required, with a waiting list if no suitable berths are available. Anyone who wants a different berth because of a larger or smaller boat submits a new application and takes priority over outside applicants. Article 8. The right to a permanent berth lapses if the berth holder cancels, if the mooring fee is not paid within 30 days of a written reminder (the amount remains recoverable), if it is established that the boat has no third-party liability insurance, or if the holder fails to comply with the regulations after a warning from the board. The boat must then leave the harbour within a period set by the board; after that, each day over the deadline is charged at 1.5 times the daily visitor rate, plus statutory interest and legal and collection costs. The board may allow payment in instalments; if an instalment is not paid, the electricity connection is cut off until payment is made. Article 9. Visitors always moor or park in consultation with the harbour master. Apart from the parking area in front of the harbour office, a motorhome may stay no longer than 3 x 24 hours, unless the harbour master on duty decides otherwise. For longer stays by visitors, the full rate applies for the first 14 days, followed by a reduced rate of 50 percent for a maximum of 2 months; after that period no berth or pitch may be taken for 1 month. Article 10. When a berth or pitch is taken after 12:00 noon, the mooring or pitch fee is due. Visitors may empty their chemical toilet; the rest of the facilities may only be used with an access card, obtainable against a deposit. Article 11. The visitor may keep the boat moored or leave the motorhome in place once the harbour master has made the berth or pitch available and the rate has been paid. The rate applies from the day of arrival until 12:00 noon on the day of departure.
Staying on board and habitation (article 12)
Berth holders may not stay overnight on board, except for a few days before departing with the boat or after returning; the harbour coordinator or harbour master must be informed. In exceptional cases the board may allow overnight stays on board for a few weeks. Visitors may stay overnight within the period referred to in article 9. Overnight stays outside these conditions are regarded as temporary or permanent habitation; temporary and permanent habitation of a boat is not permitted in the municipality of Schagen.
General rules of conduct (articles 13 to 19)
Article 13. Everyone in the harbour must maintain order, quiet and cleanliness, observe the safety rules, avoid offensive behaviour and be considerate towards fellow berth holders, visitors and local residents. Article 14. If you leave the harbour with your boat for more than 24 hours, inform the harbour master on duty; announce your return at least 24 hours in advance. The harbour master will make sure the berth is free on your return and will, where applicable, switch off the electricity connection after departure. The harbour master may release the berth during your absence and temporarily allocate it to another boat. Article 15. If you find a visiting boat at your berth on your return, moor at the reporting quay and report to the harbour master on duty, who will make your permanent berth available again as soon as possible. Article 16. Harbour masters conduct themselves in accordance with the standards, values and instructions laid down by the board. Article 17. In the recreational harbour it is not permitted to: - sail with hoisted sails, at an unsafe or disturbing speed (faster than 6 km per hour) or causing a disruptive wash; - moor the boat improperly or leave it in a neglected state; in case of negligence the harbour master may move or repair the boat at the owner's expense and risk; - take a berth other than the one allocated, without permission from the harbour coordinator or harbour master; - leave belongings unattended outside the boat; - pollute the grounds or the water with waste, including oil, fuel, bilge water, grease, household waste, waste water from the on-board toilet or animal droppings; - run engines other than to move the boat, except with permission; - make noise during the night rest, from 10 pm to 8 am; - hose down or clean the boat with drinking water, or treat it with non-biodegradable products; - make open fires, including barbecues, without permission and outside the designated places; - swim or dive in the harbour; - use personal watercraft or jet skis in the harbour, other than for mooring and casting off; - damage property of the foundation or of other users; - let dogs run off the lead; - as a berth holder, rent out the berth or moored boats to third parties or make them available to them; - pass the access card on to third parties, even temporarily; - leave the access gates open longer than necessary; - store boat trailers on the harbour grounds other than temporarily; - trade in any form whatsoever, unless expressly licensed to do so; - send spam or other inadmissible content via the harbour wifi; misuse leads to immediate disconnection, and any costs and fines are recovered from the offender; - fish with a casting rod from the quay, the jetty or a boat; - obstruct free passage on the jetties; - damage jetties and mooring posts by driving in nails or staples or screwing in screws. Article 18. Berth holders always act as hosts towards visitors and guests, helping with mooring where needed or directing them to the harbour office. Article 19. Decisions on berths for berth holders and visitors are reserved exclusively to the board.
Safety rules (articles 20 to 26)
Article 20. Gas installations on board boats and motorhomes must be installed and used safely and in accordance with the applicable regulations. Article 21. Storing and refilling flammable substances (petrol, diesel and the like) must be done with the utmost care, so that no danger arises for the surroundings or the environment. Article 22. In case of suspicious circumstances, emergencies or (imminent) dangerous situations, alert the harbour coordinator or harbour master immediately and follow their instructions precisely. In an emergency, call the emergency services immediately on 112 and follow their instructions. Article 23. Every berth holder and visitor must have a working fire extinguisher of sufficient capacity on board their boat or motorhome, with the exception of small rowing boats and dinghies. Article 24. In the event of storm, fire or other calamity, every berth holder present in the harbour area is obliged to help where necessary. Article 25. In an emergency the harbour coordinator or harbour master is at all times authorised to board any boat in the harbour and take all necessary measures to limit or prevent damage. The foundation, the board and the harbour master are not liable for any (consequential) damage resulting from this intervention. Article 26. If loss of property through theft is established, the harbour coordinator or harbour master will inform the owner as soon as possible and ask them to report the theft to the police, using the telephone number or email address in the berth records.
Environment (articles 27 to 30)
Article 27. Environmental incidents and pollution, by whomever caused and wherever in the harbour, must be reported immediately to the harbour coordinator or harbour master. Article 28. If the water is polluted with waste, including oil, fuel, bilge water, waste water from the on-board toilet or animal droppings, the owner of the boat is responsible for cleaning it up. Fines imposed by the environmental police are recovered from the berth holder or visitor. Article 29. Mechanical work (such as sanding) on wood, plastic and metal and other maintenance work may not take place in the open air without adequate screening and extraction. In case of a breach, the board will notify the berth holder in writing and take appropriate measures. Article 30. All household waste from boat or motorhome use must be placed, in rubbish bags, in the container provided. Chemical toilets may only be emptied at the facilities provided. Special waste, bulky waste and small chemical waste (such as oil and paint tins) are not accepted by the harbour; follow the harbour master's instructions for disposal. In case of a breach, the harbour master may have the pollution removed at the offender's expense.
Harbour facilities (articles 31 to 33)
Article 31. Berth holders, visitors and guests only have access to jetties A to F and the harbour building with the access card. Article 32. Berth holders and visitors may use the drinking water points and the shore power supply on the jetties and quays against payment. Where electricity is included in the rate or charged at a fixed rate, a fair use policy applies; if consumption is higher than the normal average, an additional charge may be made. The harbour masters carry out random checks on electricity consumption. Waste water and bilge water tanks can be emptied free of charge at the relevant installations, in consultation with the harbour master. Article 33. Chemical toilets can be emptied free of charge at the installation at the rear of the harbour building.
General provisions (articles 34 to 37)
Article 34. Breach of one or more provisions of these regulations entitles the harbour coordinator or harbour master to deny the offender access to the harbour, and entitles the board to take appropriate measures. Any damage, direct and indirect, is recovered in full from the responsible berth holder or visitor; damage caused by a guest is recovered from the berth holder or visitor responsible for that guest. Article 35. The board may take appropriate measures in response to a breach of contract, attributable failure or violation of these regulations. Article 36. If any article of these regulations conflicts with the law, only that article is subordinated to the law; the other articles retain their force and meaning. Article 37. In cases not covered by these regulations, or in special situations, the board decides; its decision is communicated to those concerned and recorded in writing. These regulations were approved at the board meeting of 2 February 2021 and replace the harbour regulations of 2 April 2017.
